Acceptance of Terms

    1. Acceptance of Terms
      1.1 By accessing or using hairmineralanalysis.health (“Website”), purchasing any product or service, submitting any hair sample, or creating an account, you (“Client,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”), our Privacy Policy, and any referenced policies. If you do not agree, do not use the Website or submit any hair samples.
    2. Definitions
      2.1 “HTMA” means Hair Tissue Mineral Analysis.
      2.2 “We,” “us,” and “our” mean hairmineralanalysis.health and its owners, affiliates, service providers, and agents.
      2.3 “Order” means any purchase made on the Website.
      2.4 “Submittal Form” means our proprietary online form and the corresponding paper form that must accompany each hair sample.
      2.5 “Patient” means the individual whose hair sample is submitted for analysis, whether the Client is the patient or a third party acting on the patient’s behalf.
      2.6 “TEI” means Trace Elements, Inc., the laboratory located in Addison, Texas.
    3. Eligibility
      3.1 You must be at least the age of majority in your jurisdiction and have legal capacity to enter into these Terms.
      3.2 If you submit samples for a third party (e.g., minor, dependent, client), you affirm you have the legal authority and necessary consents to do so.
    4. Medical and Diagnostic Disclaimer
      4.1 HTMA offered through the Website is a laboratory analysis service intended for informational purposes. It is not a medical diagnosis, medical treatment, or a substitute for professional medical advice, diagnosis, or care.
      4.2 We do not practice medicine and do not provide medical advice. Always consult a licensed healthcare professional for medical decisions.
      4.3 Any interpretive reports, guidance, or recommendations provided are informational and should be reviewed with a qualified healthcare provider.
    5. Ordering, Pricing, and Payment
      5.1 Prices, fees, and available services are listed on the Website and are subject to change without notice.
      5.2 Payment is due at the time of order. We may use third-party payment processors; your use of such processors is subject to their terms and policies.
      5.3 Taxes, duties, and shipping/handling fees may apply depending on your location and will be displayed at checkout where applicable.
    6. Mandatory Submittal Requirements; Forfeiture and Rejection
      6.1 Each hair sample submitted must be accompanied by complete and accurate Submittal documentation as described below.
      6.2 Failure to perform any of the following mandatory requirements will result in forfeiture of payment and rejection of the hair sample from processing:
      6.2.1 Failure to fill out and submit our proprietary online Submittal Form for each patient’s sample submitted.
      6.2.2 Failure to properly fill out and enclose a paper Submittal Form with each hair sample submitted.
      6.2.3 Failure to include the Order Number and/or the correct Order Number in either the online or paper Submittal Form.
      6.2.4 Failure to submit samples directly to TEI (Trace Elements, Inc.) laboratory in Addison, Texas and to include our distributor Account Number 6663 with the submission. We are not responsible for non-processing in such cases.
      6.3 If a sample is rejected under this section, no refunds, credits, or replacements will be issued. You are responsible for ensuring the accuracy and completeness of all Submittal Forms, Order Numbers, and required submission details including Account Number 6663.
    7. Sample Collection, Handling, Shipping, and Timeliness
      7.1 At-home, self-administered service: Our HTMA service is at-home and self-administered. We do not supply physical sample collection kits. We provide self-printable sample collection envelopes with collection instructions; you must print and use these materials correctly.
      7.2 Submission destination and identifier: All samples must be self-submitted to TEI in Addison, Texas, and must include our distributor Account Number 6663. Failure to adhere to these requirements may result in rejection or non-processing, for which we are not responsible.

    7.3 Timeliness, bundle-specific deadlines, and penalties:
    7.3.1 General late-arrival penalty: If an HTMA sample purchased fails to arrive at the laboratory within ninety (90) days from the date of purchase, a ten percent (10%) penalty fee will be charged as a prerequisite to processing the hair sample.
    7.3.2 Single panel forfeiture: For single HTMA panel purchases (non-bundles), any sample that arrives after one hundred eighty (180) days from the date of purchase will be forfeited without refund.
    7.3.3 3‑sample and 6‑sample bundle forfeiture: For all 3‑sample and 6‑sample bundle purchases (whether purchased as qualifying, promotional, or otherwise), each hair sample included in or associated with the bundle must be submitted to TEI within sixty (60) days from the original purchase date. Any hair sample that is not submitted within this period will be forfeited without refund, credit, or extension.
    7.3.4 12‑sample bundle forfeiture: For all 12‑sample bundle purchases (whether purchased as qualifying, promotional, or otherwise), each hair sample included in or associated with the bundle must be submitted to TEI within one hundred twenty (120) days from the original purchase date. Any hair sample that is not submitted within this period will be forfeited without refund, credit, or extension.

    7.4 You are responsible for monitoring delivery timelines; delays caused by you, carriers, customs, or failure to use correct submission details (including Account Number 6663) may trigger the penalties and forfeiture described above.
    7.5 Client responsibilities: You are responsible for collecting hair samples per our instructions, ensuring the sample is uncontaminated, properly packaged, and shipped in a timely manner to the designated laboratory address, and bearing all shipping costs and risk of loss during transit.
    7.6 We reserve the right to reject samples that are contaminated, insufficient in quantity, improperly packaged, past any stated time window, or otherwise not meeting our standards, in which case Sections 6, 8, and 11 apply.

    1. Operational Requirements (Integrated)
      8.1 Use our self-printable sample collection envelopes and follow the provided instructions; no physical kits are supplied.
      8.2 Submit all hair samples directly to TEI in Addison, Texas and include distributor Account Number 6663 with the submission.
      8.3 Ensure the online and paper Submittal Forms are properly completed and include the correct Order Number.
      8.4 Ensure your sample arrives at TEI within ninety (90) days of purchase; otherwise, a 10% penalty fee applies, subject to the bundle-specific deadlines in Section 7.3.3 and 7.3.4. For single HTMA panel purchases (non-bundles), samples arriving after 180 days will be forfeited without refund.
      8.5 Provide and maintain a correct email address; all reports are delivered as PDF (digital) only (see Section 10).
    2. Processing Times and Availability
      9.1 Estimated processing times are provided as guidance and are not guaranteed. Delays may occur due to volume, logistics, laboratory considerations, regulatory compliance, or circumstances beyond our control.
      9.2 We may suspend or discontinue services temporarily or permanently without liability.
    3. Results Delivery and Use
      10.1 Results may be delivered electronically through a secure portal, via email, or by other reasonable means. You are responsible for maintaining accurate contact information and access credentials.
      10.2 Report format: Only PDF (digital) reports will be provided. You must supply and maintain a correct, functioning email address for receipt of results. We are not responsible for non-delivery due to incorrect or inaccessible email addresses, filtering, or inbox limitations.
      10.3 You acknowledge that interpretation of HTMA results requires context and professional judgment. Results should be reviewed with a qualified healthcare provider.
    4. Refunds, Returns, and Resubmissions
      11.1 Except where expressly stated in these Terms or required by applicable law, all sales are final.
      11.2 No refunds or credits will be provided for:
      11.2.1 Failure to meet the mandatory Submittal requirements in Section 6.
      11.2.2 Samples that are lost in transit, contaminated, insufficient, or otherwise unprocessable due to Client error.
      11.2.3 Samples forfeited under Section 7.3.2 (single HTMA panels arriving after 180 days).
      11.2.4 Samples forfeited under Sections 7.3.3 or 7.3.4 (bundle-specific forfeiture for 3‑, 6‑, and 12‑sample bundles).
      11.3 The 10% penalty fee under Section 7.3.1 applies to late-arriving samples (post-90 days) as a prerequisite to processing. Failure to pay the penalty fee may result in non-processing and forfeiture.
      11.4 If we determine, in our sole discretion, that a sample is unprocessable due to our error, we may offer a complimentary resubmission option or a refund. Any refund, if provided, will be limited to the price paid for the affected service, less fifteen percent (15%) to cover administrative costs and processing fees.
    5. Client Representations and Warranties
      12.1 You represent and warrant that:
      12.1.1 All information you provide, including Submittal Forms and Order Numbers, is true, accurate, complete, and current.
      12.1.2 You have obtained all necessary consents and authorizations from the patient for collection and analysis of hair samples.
      12.1.3 You shall comply with all sample collection and shipping instructions and all applicable laws and regulations.
    6. Right to Refuse Service; Customer Conduct; Staff Safety
      13.1 We reserve the right, at our sole discretion, to refuse service, refuse or cancel the sale of any products or services, and/or terminate any ongoing or future provision of products or services to any customer whose conduct we consider to be discourteous, disrespectful, abusive, threatening, harassing, or otherwise unreasonable.
      13.2 The safety, well-being, and security of our staff, contractors, and representatives are a priority. Any conduct that compromises, or is reasonably perceived to compromise, staff safety will not be tolerated and may result in immediate refusal or termination of service without notice.

    13.3 Prepayment of Samples; Non‑Payment Consequences
    13.3.1 All hair samples must be prepaid in full at the time of purchase and prior to submission to the laboratory. Submission of any sample that does not correspond to a paid Order is not permitted.
    13.3.2 If a sample is submitted without payment having been received by us, we reserve the right to discard or otherwise dispose of the sample without liability, refund, or credit. Such action is without prejudice to any other rights or remedies we may have under these Terms or at law.
    13.3.3 If, in our sole discretion, we determine that the failure to prepay was wilful or intentional, we may, in addition to discarding the sample, suspend or permanently terminate the customer’s access to the Website, cancel any outstanding Orders, and strip or revoke the customer’s membership or account privileges.

    1. Privacy and Data Protection
      14.1 Our handling of personal data, including patient information and lab results, is governed by our Privacy Policy. By using the Website and submitting samples, you consent to the collection, use, storage, and disclosure of information as described therein.
      14.2 You agree not to share access credentials and to protect your account against unauthorized access.
    2. Intellectual Property
      15.1 All content on the Website, including text, graphics, logos, trademarks, images, software, and forms (including the proprietary Submittal Form), is owned by us or our licensors and protected by intellectual property laws.
      15.2 You may not copy, modify, distribute, reverse engineer, or create derivative works from any Website content or forms, except as expressly permitted for submitting samples.
    3. Prohibited Conduct
      16.1 You agree not to:
      16.1.1 Use the Website for unlawful purposes or to violate any third-party rights.
      16.1.2 Submit fraudulent, misleading, or unauthorized samples.
      16.1.3 Interfere with or disrupt the Website or its security features.
      16.1.4 Attempt to gain unauthorized access to accounts, systems, or data.
    4. Third-Party Services and Links
      17.1 The Website may contain links to third-party sites or utilize third-party services. We are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk.
    5. Compliance and Regulatory Matters
      18.1 You are responsible for compliance with all local, state, national, and international laws applicable to the collection, shipment, and handling of hair samples, including customs requirements where applicable.
      18.2 We may decline orders or reject samples to comply with legal or regulatory obligations.
    6. Limitation of Liability
      19.1 To the maximum extent permitted by law, we and our affiliates shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, loss of data, or business interruption, arising out of or related to your use of the Website or services, sample rejection, or processing delays.
      19.2 Our total liability for any claim arising from or relating to these Terms, the Website, or services shall not exceed the amount you paid for the specific service giving rise to the claim.
    7. Disclaimers
      20.1 Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
      20.2 We do not warrant that results will be error-free, complete, or suitable for any particular clinical use.
    8. Indemnification
      21.1 You agree to indemnify, defend, and hold harmless hairmineralanalysis.health, its owners, affiliates, officers, employees, contractors, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Website or services; (c) your submission of samples; or (d) your violation of applicable law or third-party rights.
    9. Force Majeure
      22.1 We are not liable for any failure or delay in performance due to events beyond our reasonable control, including acts of God, natural disasters, pandemics, labor disputes, governmental actions, supply chain interruptions, or failures of carriers or communications.
    10. Governing Law; Venue
      23.1 These Terms are governed by the laws of Singapore, without regard to its conflict of laws principles.
      23.2 Any dispute shall be brought exclusively in the courts of Singapore, and you consent to personal jurisdiction and venue in those courts.
      23.3 Notwithstanding the foregoing, we recognize that certain consumer protection laws may be non-waivable; to the extent required, such mandatory consumer protections of your place of residence may apply.
    11. Changes to Terms
      24.1 We may update these Terms at any time. The updated Terms will be posted on the Website with a revised “Last updated” date. Continued use of the Website or submission of samples after changes constitutes acceptance of the updated Terms.
    12. Severability
      25.1 If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
    13. No Waiver
      26.1 Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
    14. Notices

    15. Entire Agreement
      28.1 These Terms, together with the Privacy Policy and any service-specific policies, constitute the entire agreement between you and hairmineralanalysis.health regarding the Website and services, and supersede all prior or contemporaneous communications.
